The USD 1 Million Scheme (FEMA)
Under the regulations of the Reserve Bank of India (RBI) and the Foreign Exchange Management Act (FEMA), Non-Resident Indians (NRIs) and Persons of Indian Origin (PIOs) are permitted to remit an amount up to USD 1 million per financial year (April – March) out of balances held in their NRO accounts.
NRO vs NRE Repatriation
| Account Type | Repatriation Limit | Taxability |
|---|---|---|
| NRO Account | Restricted to USD 1 Million / FY | Interest is taxable in India. |
| NRE Account | Freely Repatriable (No Limit) | Interest is tax-free in India. |
| FCNR Account | Freely Repatriable (No Limit) | Interest is tax-free in India. |
Documentation Required
Transferring funds out of an NRO account requires strict compliance with Indian Income Tax Laws to ensure that the money being sent abroad has been properly taxed. Banks require two main documents before processing the wire transfer:
- Form 15CB: A certificate issued by an Indian Chartered Accountant verifying that appropriate TDS (Tax Deducted at Source) or capital gains tax has been paid on the money being transferred.
- Form 15CA: A self-declaration form submitted online on the Income Tax Portal by the NRI, based on the CA's 15CB certificate.
